Exemptions from notification by data controllers

Even if you process personal data, you may not need to notify the Information Commissioner. (See Notification.)  However, data controllers must still comply with the provisions of the Data Protection Act even if they are exempt from notification. (See Principles of Data Protection.)

Individuals are exempt from notification if the only data processed are for personal, domestic and household affairs (including recreational purposes).  Examples might be a personal address list, Christmas card list or data held in connection with a hobby.  Some clubs and societies ("not for profit" organisations) may also be exempt.  The leaflet called "Notification Exemptions - a self assessment Guide" will tell you more, or you can visit the website at http://www.dataprotection.gov.uk.
